§1 GENERAL PROVISIONS
1. Online store [hereinafter referred to as ‘Shop’] conducts wholesale and retail sale via the Internet, pursuant to these Terms and Conditions [hereinafter ‘Terms and Conditions’].

3. The person making purchases in the Store [hereinafter the ‘Customer’] makes the decision to buy and pay voluntarily.
4. All available products and their photos in the store are the property of the store owner and are free from physical and legal defects.
5. The Terms and Conditions are an integral part of the sales contract concluded with the Customer.
§2 ORDERS
1. Orders can be placed via the www.bexa.store platform
2. Online orders can be placed 24 hours a day, all year round.
3. The Seller provides information about the number of business days needed for delivery and execution of the order. The information is provided on the store’s website.
4. The condition of the contract is that the Customer provides data allowing verification of the Customer and the recipient of the goods. The store confirms the acceptance of the order by e-mail. In the absence of such information, the Customer should contact the Store. The store has the right to refuse acceptance of an order, limit the method of payment or request prepayment in case the order raises reasonable doubts as to the accuracy of the data and/or reliability of the Customer.
5. The information on the Store's website does not constitute an offer within the meaning of the Civil Code. When placing an order, the Customer places an offer to purchase a specific product. The conclusion of the sales contract comes as soon as the Customer confirms the order by clicking the "ORDER AND PAY" button. The order confirmed by the Customer is a Purchase-Sale agreement in line with the meaning of the Civil Code.
6. Placing an order is equivalent to acceptance of the Shop’s Terms and Conditions. It is also a voluntary desire to purchase the ordered goods, and consent to the processing of the Customer's personal data by the Store for purposes related to the execution of the order.
7. The customer may cancel the order by e-mail or by phone, until the order status changes to "ORDER SHIPPED".
§3 PAYMENTS
1. Product prices given in the store are:
a) for individual clients, gross prices (including VAT).
b) for registered business customers net prices (excluding VAT)
2. The prices of parcels are specified in the delivery price list available when placing the order.
3. The customer can choose from the following payment methods:
a) cash on delivery - then the payment is made in cash on delivery of the goods,
b) a traditional transfer - then the Store reserves the goods in the warehouse and sends it to the address indicated by the Customer after the payment is credited to the Store's bank account indicated for this purpose in an email to the Customer or on the Store's website
c) PayU online payment - the shop panel will redirect the customer to the outside website, where it is safe to pay for the purchased goods. The payment is made immediately, therefore the realization of the order is as fast as possible.
d) payment by Pay Pal - the store panel will redirect the customer to the outside site, where it is safe to pay for the purchased goods. The payment is made immediately, therefore the realization of the order is as fast as possible.
e) by credit card - the store panel will redirect the customer to the outside site, where it is safe to pay for the purchased goods. The payment is made immediately, therefore the realization of the order is as fast as possible.
f) collection in person at the company's office - then the payment is made in cash on collection of the goods at the company's headquarters. Office address: M. Skłodowskiej-Curie 182a, 59-300 Lubin. 4. The condition for the shipment of the goods is payment for the goods and shipment (if you choose the option of delivery after the prepayment).
5. If the payment for the order is not recorded in the Store's bank account within 14 days of the order confirmation, in case of the payment by ‘BANK TRANSFER’, the Store reserves the right to automatically cancel the order.
6. Order processing, in case of the payment by "BANK TRANSFER’, follows after the money is credited on the account.
§4 SHIPMENT OF THE ORDER
1. The cost of delivery is covered by the Customer.
2. The ordered goods are sent by the Store via delivery companies or made available for collection in person by the customer at the company's headquarters.
3. Shipping costs depend on the selected form of delivery and delivery company. They are added to the total cost of the order.
4. In the case of payment in a form different than cash on delivery, the time of shipment is extended by the time between placing the order and the date of crediting the payment on the Store's bank account.
5. The shop is not responsible for the timelines and punctuality of the courier company.
§5 RETURN OF ORDERED GOODS
1. The Customer has the right to withdraw from this contract (cancel the purchased product) within 14 days without giving a reason. The right to withdraw from the contract expires after 14 days from the date of receipt of the shipment with the goods.
2. To exercise the right to withdraw from the contract you should send the withdrawal form which is attached to every form or download the form from here and send it to an e-mail bexa@bexa.store before aforementioned deadline (14 days).
3. In the event of withdrawal from the contract and returning the product, the refund will be made immediately and no later than within 7 days from the date of receipt of the returned product.
4. The return of the payment shall be made by bank transfer, unless the customer expressly requests a different method of refunding.
5. Direct costs of returning the purchased products shall be borne by the Customer (delivery cost).
Please send back the purchased, undamaged products to the address of our company. However, please do it no later than 14 days from the day on which you informed us about the withdrawal from this contract.

§ 6 Replacement of goods
1. The Customer has the right to exchange the product within 14 days from the date of receipt if the size has been wrongly chosen.
2. In order for the exchange to be completed, the Customer should check the availability of the exchanged products on the store's website, and then use the form that is attached to each order or download the form from here and complete it.
3. In the situation when the Customer returns the product and the selected new product parameters are not available, the Seller will refund the price of the product to the bank account indicated in the form.
4. The exchange of goods is carried out immediately after receiving the parcel with the returned Goods.
5. Direct costs of returning the purchased products shall be borne by the Customer (delivery cost).
Please send back the purchased, undamaged products to the address of our company. However, please do it no later than 14 days from the day on which you informed us about the withdrawal from this contract.

§ 7 COMPLAINTS
1. Each product purchased in the online store is covered by the warranty. The Customer can make a complaint about a product purchased from the Store within 2 weeks from the date of receipt if it is found to be damaged, incomplete, defective or inconsistent with the description
2. Any complaints related to the Products or the fulfilment of the Contract of Sale, the Customer may submit to the address of the Seller, in writing, using the complaint form, which is attached to each order, or may be downloaded from here form and completed.
3. In the complaint form, the Customer should include a description of the problem.
4. After completing the complaint form, the Customer should return the product along with the form and proof of purchase to the following address:

5. The Seller will respond to the complaint and provide the Customer with an answer within 14 days from the date of receipt of the parcel with the returned Goods.
§8 INTELLECTUAL PROPERTY
1. It is prohibited to copy, use and distribute any materials published on the Store's website (including photos and descriptions of goods) without the Store's written consent.
§9 NEWSLETTER
The ‘Newsletter bexa.store’ service (hereinafter ‘newsletter’) enables all interested Customers to automatically receive information about new products in the Store, sales, discounts and other commercial information related to the Store's activities.
The use of the newsletter service is voluntary and perpetual (the contract for the ‘bexa.store Newsletter’ service is concluded for an indefinite period). In order to provide the newsletter service, the Service Provider obtains e-mail addresses from interested Clients.
The Customer who has consented to receive the newsletter and has registered for this purpose, at any time has the option to change or delete his data obtained in the registration process of the newsletter in accordance with the guidelines indicated on the website of the Service Provider. The customer may terminate the contract for the ‘Newsletter’service at any time, without giving a reason. For this purpose, the Customer may use the link cancelling the subscription of the service or send a statement by e-mail to the Service Provider (bexa@bexa.store).
In order to register the newsletter service, you must consent to the processing of personal data in the form of the Customer's e-mail address by the Service Provider and confirm that you read the Terms and Conditions in accordance with the guidelines indicated on the Service Provider's Website.
It is not allowed to use e-mail addresses of people who did not register for the newsletter service.
§10 PERSONAL DATA
1. Service Provider Group B.H.E. Katarzyna Kuciejczyk with headquarters in Lubin 59-300, ul. Skłodowskiej-Curie 182a, NIP: PL 6921489111, is registered in the Central Register and Information on Economic Activity (CEIDG), following art. 13(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) - (hereinafter referred to as Regulation) informs that:
a) The Service provider is the administrator of the Customer's personal data,
b) The Service provider processes personal data of the Customer in order to deliver the Order; give access to the Customer Account service; provide information about the Products to the extent necessary to perform the contract: art. 6(1b) of the Regulation; testing the level of customer satisfaction; determining the level of service quality and customer satisfaction with the services, provided that it is the legitimate pursuit of the Service Provider’s interest: art. 6(1f) of the Regulation; using direct marketing, provided that it is a legitimate pursuit of the Service Provider’s interest: art. 6(1f) of the Regulations; providing commercial information as part of direct marketing based on the consent of the person whose data is being processed: art. 6(1a) of the Regulations,
c) Personal data of the Customer may be transferred to trusted partners of the Service Provider who participate in providing services by the Service Provider, such as courier companies that deliver the Products, manufacturers of Products to the extent necessary to service warranty claims, accounting services, system administrators and marketing team, telecommunications and IT programs used by the Service Provider, as well as, administrators of hosting servers on which data is stored.
d) Furthermore, pursuant to art. 13(2) of the Regulation. The Service Provider is obliged to ensure fairness and transparency of the processing of the data, therefore, informs of the following:
i) the period during which personal data will be stored includes the period of use of services provided electronically, pursuing claims arising from contracts of sale, period of implementation of obligations provided by law such as warranty or warranty service provided by the manufacturers of Products and the period prescribed by law, including tax law and accounting law. In the scope of data processed for the purposes of direct marketing, data will be processed for this purpose until the moment of the Customer's objection or withdrawal of consent;
ii) the Customer has the right to request from the Service Provider the right to rectify, delete or limit the processing of the data or the right to object to the processing based on the legitimate interest of the Service Provider, as well as, the right to data transfer;
iii) in the scope of rendering the ‘Newsletter bexa.store’ service. The customer has the right to withdraw consent for processing at any time without affecting the legality of the processing, which was made on the basis of consent before its withdrawal.
e) The service provider, when processing personal data, adheres to mandatory legal provisions and declares to ensure an appropriate level of security of data processing.
§11 Entry into force and amendments to the Terms and Conditions
1. Terms and Conditions come into force on the day of publication on the website www.bexa.store.pl
2. The Shop reserves the right to change the Terms and Conditions without notice, which shall enter into force on the day of their publication on the Store's website. For contracts concluded before the amendment of the Terms and Conditions, the version of the Terms and Conditions in force on the date of placing the Order by the Customer shall apply.
3. In matters not covered by these Terms and Conditions, the law applicable on the territory of the Republic of Poland should be implemented, in particular the Civil Code and in the case of Customers: The Act of 30/05/2014 on consumer rights shall apply.
